Title Insurance

If you are planning on purchasing a property in Mexico it is important to protect yourself in the event of possible legal disputes. Conflicts over ownership rights to a home or piece of land do happen, and one of the ways to insure against potential financial loss is to obtain title insurance.

What is title insurance?
It´s an agreement of indemnity between the purchaser and the insurance company, which means that with  title insurance policy you will be protected in case there is ever any claim in title. This is could be as a consequence of many things: fraud, forgeddocuments, lost heirs and the overlaps of property.

Here´s an example. Your neighbor has title insurance and and has just completed a survey of his land. He´s determined that his property actually overlaps on to yours, and in the area of overlap you have a building- let´s say an apartment or a condo. Theoretically this building is on your neighbor´s property, which means that owns it. He is the owner of everything that is built over his property. That is a clear claim in title, and if you as the developer have title insurance it would be defended in court.

Why is it important?
Title insurance is the only financial vehicle through which you can get your money back in the event of a claim in title where you stand to lose your property. Here in Mexico it is the only way through in which you can be protected. It´s a guarantee that says: ¨You can get your money back if you lose your property due to fraud or a claim in title.¨ If you don´t have title insurance and there is a claim in title then you are on your own and would have to fight off any litigation to protect your property. The attorneys, the notary public, the government, and public registry will not help you.

What are the legal effects if I do have the title insurance?
Prior to insuring the property your lawyers have to verify that the property is free and clear of any liens. They also must confirm that the seller is the rightful owner. This is done through the title research which verifies that everything is in order, giving you a complete chain of title from beginning to end, even going back until the time of the revolution if necessary. Every single transfer of title or modification of the property is checked to see if it was done appropriately and the underwriting process we will determine if the property is insurable or not. If anything is wrong the insurance policy could have an exception of coverage. Or you may be denied the granting of the insurance policy on that property.

Mexican Caribbean Life = House Guests

Once you become a resident of the Mexican Caribbean, you discover that friends and family members -some of which you had not heard about in years, centuries or even millennia, decide it's time to pay a visit. Nothing like a few weeks or months at your home to reestablish friendship and family bonds, right?
How can you prevent these family and friends and their continuous visits? Offer them an ideal way to ensure that they will see you and will enjoy the Caribbean, but without having to settle permanently in your house.  Suggest they visit you on a cruise!
The major cruise lines offer Cozumel as a destination, with cruise ships leaving from California, Florida, Louisiana and Texas. Cozumel is an island conveniently located close to Playa del Carmen, Cancun and Tulum and it is known to be an ideal place for water sports such as diving and snorkeling.

Attractions
Cozumel is not only a beautiful tropical island with powdery white sands and turquoise waters, there is plenty to do and see for visitors!
If your 3rd cousin loves jewelry, Cozumel has plenty of specialized shops offering a wide array of styles and very reasonable prices. You can also find all sorts of Mexican crafts shops, specialized Tequila and Mescal stands, and so many other things.
For your adventurous friends, Cozumel also has natural attractions such as the ChanKanaab National Park; where you can swim with dolphins, manatees and other species. Also it is one of the best locations to practice snorkeling and scuba, and see the over 250 species of fish that live there.
In addition to sunbathing on the beaches, cruise lines will offer shore excursions for organized tours to Cozumel's main attractions.

Shore Excursions
Along with excursions in Cozumel, your cruise line will offer shore excursions to the nearby Yucatan peninsula. The most frequent Yucatan shore excursions from a Cozumel cruise are trips to Mayan ruin sites such as: Tulum, Chichen Itza and Coba. The Yucatan Coast, called Riviera Maya, has many caverns and cenotes (sinkholes) as well as plenty of natural parks such as Xcaret, Xel-ha or X-Plore among others.

But there is more!
So after you and your family or friends enjoy your reunion, there is more to come! Most of these cruises extend from three up to seventeen days. That means they will surely have to leave after a day or two in Cozumel, and you can go back to your peaceful Caribbean home and enjoy a margarita, or two.

What better way to recover from the heartbreaking farewells than the promise of more beautiful Caribbean spots awaiting for their arrival. Go ahead talk to them about the beauty of the Bahamas, Grand Cayman or Jamaica; or even Belize and Costa Rica. Some other cruises stop in the U.S Virgin Islands, Puerto Rico, St. Marteen or Aruba.
Cruises are an excellent choice for everyone, from couples on their honeymoon, to families and the elderly couple that wants to relax and enjoy. Explore the services and costs for different cruise lines and make sure your friends and family pick the right one for their needs and their lifestyle.
Now if you have any question about this or any of the Top Mexico Real Estate properties we have listed in Playa Del Carmen, The Riviera Maya or anywhere throughout Mexico, please feel free to contact any of our Top Mexico Buyers’ Representatives and we will be glad to help you find your very own piece of paradise.

With lifestyle and real state shows becoming the fastest growing genre of television programming in the United States and Canada, the Top Mexico Channel realized that Mexico was missing a promotional outlet that could solely promote the real estate market in Mexico. The Top Mexico Channel crafted a perfect blend of Mexico lifestyle living meets Mexico real estate with its’ flagship debut project “Mi Casa es tu Casa with Thomas Lloyd”. The reason for creating this show was not only to entertain, but to also educate guests on the “ins” and “outs” of how to buy real estate safely in Mexico.

“MI Casa es tu Casa” will be filmed entirely in the Riviera Maya and is the very first television series dedicated to promoting, and selling, the Riviera Maya. The first season will have 6 episodes, with a new episode airing every month on the Top Mexico Channel.

The first episode, “Golf Living in Paradise”, follows our guests John and Lydia, both avid golfers, who are looking to call the Riviera Maya their “home course”.  With the help of Thomas Lloyd and his TOP Buyers Representatives, John and Lydia begin, searching and ultimately find the perfect “fairway paradise” home they’ve been looking for their whole life.

Buyer’s Representative or Seller’s Representative… Whats Better?

Buyer’s Representative vs. Seller’s Representative? Many of our prospective clients do not understand the differences between these two agents. Most people see a listing on the internet or see a sign in the yard and think that the authority, the person who knows everything about that property is the agent listed, that is simply not the case. So I would like to share some facts about buyer’s and seller’s representatives. Whether you are planning to buy real estate in Mexico or anywhere else, knowing the difference between these two can make a huge difference, saving you time and money when buying real estate.

What is a Seller’s Representative?
Traditionally, in Mexico the seller’s representative is the real estate agent that is contacted by the property owner to sell the property. The seller’s representative counsels the seller and effectively prices the property in a highly competitive marketplace. The seller’s representative will list the property and market it through websites, signs, real estate ads and hubs. The seller’s representative will deals with the prospective clients, organizes tours of the property and setup open house events. They will contract provisions to protect the seller and negotiating in the best Interest of the seller. The purpose of this, of course, is to obtain the highest price possible for the property.
The seller’s representative is hired and paid by the SELLER, so when you call one of these nice friendly realtors on the signs or websites you are trusting someone that is hired to negotiate in best Interest of the seller, not you; the prospective buyer!!

What is a Buyer’s Representative?
If you are considering investing in Real Estate in Mexico, having a buyer’s representative will save you money, time and hassle. A buyer’s representative is a professional Real Estate Agent committed to protect your interests and only have one mission: to help you find and purchase your dream home!
The client shares their wish list with the buyer’s representative. They can help explore financing options and determine a budget. The buyer’s representative starts looking for property on your behalf, compiling a list that meets your criteria and present all the options to you in the comfort of your hometown. When you are ready to visit the area you are interested in they will prepare a real estate discovery trip. The buyer’s rep will pick you up at your hotel, for a nice, no pressure and FUN real estate tour; showing you the properties that you selected. No surprises! They can verifying property taxes, utilities and the value of the property. Once you have selected a property, the buyer’s rep will structure an offer and present it to the Seller's representative. The Buyer’s representative will do all the negotiating and contract provisions to protect the buyer. The buyer’s representative will be there for you during the entire process of purchasing your new dream home in Mexico.

The buyer’s representative should put your interests ahead of the seller and ahead of their own. Here at Top Mexico Real Estate, we pride ourselves for being a Buyer’s Representative, our Real Estate Agents can help you find the best property, while keep your interests their the top priority.
Now if you have any question about this or any of the TOP MEXICO REAL ESTATE properties we have listed in Playa Del Carmen, The Riviera Maya or anywhere throughout Mexico, please feel free to contact any of our TOP MEXICO EXPERT SALES TEAM and we will be glad to help you find your very own piece of paradise.
